Sree Kallakulathinkara Sree Nagar temple which is a kavu existing from time immemorial. The above said kavu is situated in 25 cents of property situated in Survey No.100/6 of Tirupuram village. Originally the kavu having property to an extent of 1.54 acres situated in Survey No. 100/6 of Tirupuram village, which is recorded as kavu puramboku in all the revenue records.

The Government ignoring the fact that the property belongs to the deity has forcefully encroached into the property of the temple and has established a school therein without acquiring the property of the temple by resorting to the provisions of law. At that time the temple was being managed by the public and there was no objection raised when the Government encroached into the property and set up the school. Though the property having an extent of 1.54 acres situated in Survey No.100/6 of Tirupuram village, clearly belongs to Sree Nagarkavu temple of Tirupuram and clearly stated as a kavu in all the revenue records, at present the temple has only 25 cents Subsequently, the devotees of the temple have constituted a Trust and has filed this case for the recovery of the temple land.

The mandapam is situated got its name Pooja pura after the construction of Saraswathi Mandapam which was meant to be used for poojas during the Navarathri festival. This mandapam was constructed by Swathi Thirunal Rama Varma Maharaja, who ruled the kingdom from 1829 to 1847. Before the place got this name as Pooja pura, the western portion of that area was known as Chaadiyara, the north-eastern area was called as Chenkalloor and south-east area was called as Melankkodu. East and southern part of this area was Government land which was having no name. So in effect the present place called Pooja pura consists of Chaadiyara, Chenkalloor, Melankkodu areas and the Government land which was having no name. The above said old names of these places before it has become Pooja pura is available in all ancient documents. These names are even now being used in all current documents that are being executed. The Mandapam which was constructed in the year just before 1839 was originally known as Vijaya Dasami Mandapam in all the ancient records. This Mandapam is mentioned as Vijaya Dasami Mandapam, Pooja pura Mandapam and Pooja pura.

The Vijaya Dasami Mandapam which is presently known as Saraswathi Mandapam Poojappura, and now illegally under the possession and ownership of the Corporation of Thiruvananthapuram is being misused for the purpose of non religious activities thereby destroying the sanctity of the Mandapam and against the purpose for which it was originally constructed. Though seversal rounds of litigation was launched by many the corporation raised claim over the mandapam as it is recorded so in the asset register maintained by the corporation.

Sree Muthararamman temple in Vengannoor Street, Thiruvananthapuram District. This temple is centuries old and trust was registered in the year 2020 and prior to that the temple was being managed by devotees themselves without forming any official trust. The temple is situated in 10 cents of property situated in Sy.No.80/5 of Pallichal Village.

On enquiry the it was learned that the property having an extent of 1.37 acres situated in Sy.No.80/5 of Pallichal Village belongs to the temple. In all the revenue records the above said property is recorded as the property of the Sree Mutharamman Temple. Matters being so, the Land Tribunal Board, Thiruvananthapuram has mutated the property of the minor deity of Sree Mutharamman kovil having an extent of 1.37 acres situated in Survey No. 80/5 in Pallichal Village by issuing notice to some persons who have no connection with the temple and effectively issued purchase certificate on behalf of the back drop of the temple authorities and in spite of the petition filed by the petitioner before the Hon’ble District Judge no action whatsoever have been taken till date. Hence this case was filed by the trust to recover the land of the deity

Koloor Siva Temple in the Neyyattinkara Taluk is included in the list of incorporated Devaswom in Schedule- 1 of the Travancore Cochin Hindu Religious Institutions Act & Rules having an extent of 5.41 Acres situated in Survey No. 137/1 (Re-survey No. 21/6 in Block No.27 of Keezharoor Village) is not secured and the temple situated in that property is renovated.

This writ petition is filed in the backdrop of the fact that property having an extent of 5.41 Acres situated in Survey No. 137/1 (Re-survey No. 21/6 in Block No.27) of Keezharoor Village belonging to Koloor Siva Temple which is a prominent temple in Neyyattinkara Taluk under Travancore Devaswom Board and is situated in Keezharoor Village of Thiruvananthapuram District have been encroached upon and being enjoyed by creating false and invalid documents and the Devaswom and other authorities are not taking any action whatsoever to remove the encroachment.

 

 

This temple was originally a Mahadeva (KiraathaMoorthi Temple) and there after it was destroyed. The temple was renovated around 500 years back adding the Sreekrishna Temple also. Around 70 years back the temple was again destroyed and in 2002 it was renovated again. Now the temple is under the control of Travancore Devaswom Board. . This temple is centuries old , and altogether 93.31 Acres of land belongs to the temple. From the settlement register it is evident that 93.31 Acres of land in Sy No. 2511,2507,2508,2510 of Melthonnakkal Village belongs to Sreepadham Keezhattigal Devaswom. In this settlement register it is also clearly stated that this property has been earmarked for Sreepaadham and at present the temple is in possession of 85cents only.

The case is filed seeking relief of directions quashing report No.A1-96/2009 dated 17.07.2019 of the Tahsildar, direction to the authorities to take appropriate steps to evict all the encroachers and reclaim the entire extent of 93.31 Acres of land in Sy.no. 2511,2507,2508,2510 of Melthonnakkal Village described as Sreepaadham Keezhatingal Devaswom Vaka and protect the same from encroachment, to declare that the property with an extent of 93.31 Acres of land comprised in Sy No. 2511,2507,2508,2510 of Melthonnakkal Village belongs to SreepaadhamKeezhattinalDevaswom being the Devaswom property as per Settlement Register and the pattayams issued in relation to this property belonging to the Devaswom are void and and invalid and would not bind to the Deity and to conduct an enquiry in to the encroachment of Devaswom property having extent of 93.31 Acres of land in Sy no. 2511,2507,2508,2510 of Melthonnakkal Village described as SreepaadhamKeezhatingal DevaswomVaka and file a report as directed by the Supreme Court.

Sree Lakshmi Varahamoorthy Temple which is situated on the western side of Sree Padmanabhaswami Temple, Thiruvanthapuram and it was a major devaswom in the Valiyachala group even during the regime of Travancore Kings. The temple as well as its properties were handover to the Travancore Devaswom by the then Ruler of Travancore after the independence of India by way of a covenant which was executed the then Ruler of Travancore, the then Ruler of Kochi and the representative of Government of India. The property which is now known as Putherikkandam maithanam and EMS memorial park, is a property having an extent of 0.7713 hectors of land. It was mainly a paddy land which is situated in Sy.Nos. 2800,2804,2811 to 2814, 2817 and 2819 of Thycadu Village. This paddy land was used to cultivate “Putheri” for the purpose of use in Sree Padmanabhaswami temple. The entire land is recorded as a devaswom land belonging to Sreevaraham Devaswom is now in possession of the Government and the Corporation of Thiruvananthapuram.
